Training, Cancellation, and Refund Policy (aka Terms and Conditions)

These terms and conditions serve are a contract between the participant, the booking party (if not the participant), and Nelkinda Software Craft Pvt Ltd (hereafter Nelkinda). They apply to all training (classroom training, in-house training, and web-based/online training) conducted by Nelkinda.

Preparation

• Training topics may have preconditions, for example require a certain skill or knowledge. It is the sole responsibility of the participant and the booking party to ensure that their participants have the required prior skills and knowledge for a specific training.
• In case the booking party is not the participant, the booking party must inform Nelkinda of the name(s) of the participant(s) at the time of booking.

Code of Conduct

• Non-Discrimination Nelkinda is a non-discrimination environment. Discrimination or harassment of others based on any grounds (gender, social status, caste, religion, ethnicity, origin, sexual orientation, whatever) will not be tolerated.
• Learning Environment Nelkinda expects all participants to contribute to maximize the learning effect for all participants. It is expected that participants will therefore behave professionally.
• Exclusion Nelkinda reserves the right to remove participants from the training in case they violate the code of conduct. In that case, there will be no refund.

Change of Venue and Trainer

• Nelkinda reserves the right to change the venue as long as it is within 30km vicinity of the original venue.
• Nelkinda reserves the right to change the trainer in case the originally announced trainer is not available due to unforeseen circumstances (for example sickness of the trainer). Nelkinda takes care that the substitute trainer has sufficient skills for the training topic of the training class.

Cancellation by Nelkinda

• Nelkinda reserves the right to cancel the training course due to insufficient enrollment or unavailability of the trainer at least 2 days advance of the scheduled date of training. The notification regarding same will be provided with the option to reschedule for a future training date or to receive a full refund of the training cost.
• Nelkinda is not responsible for any expenses (for example travel or accommodation tickets) incurred by a participant, even if the training is cancelled.
• If the training is cancelled due to unforeseen circumstances (for example floods, sickness of the trainer) the notification regarding same will be provided with the option to reschedule for a future training date or to receive a full refund of training cost.

Substitution

• In general, the booking party has the right to change the participant.
• The right of substitution can be limited in case of discounts. In case of discounts, substitution is only possible if the same discounts would be applicable for the new participant. In other cases, substitution is possible by paying the difference fee to cover for the non-applicable discount.

Cancellation by Participant

• Cancellation by the booking party has to be submitted to training@nelkinda.com.
• The following table describes the cancellation rules and refunds eligibility in case of cancellation by the booking party or no-show by the participant.

• Booking fees from booking platforms will not be refunded by Nelkinda.
• Any refunds due to cancellation will be paid back to the booking party within a week from the notification regarding the details required for the refund (for example, bank details).

Notes

• If the training cost is not paid by as per below mentioned payment terms, Nelkinda reserves the rights to withdraw the participant from the training.

• For quality and marketing purposes, Nelkinda has the right to take photographs and video recordings of classroom and web-based/online training. The booking party and the participants agree that they may appear on such photographs and recordings.

Copyright

• Unless stated otherwise, the training material is copyrighted by Nelkinda.
• The booking party and the participants acknowledge the copyright of the training material and will not make any copies of it. In case of making a copy without permission of Nelkinda, the booking party agrees to pay damages to Nelkinda in the height of a regular training fee without any discounts for each copy made.
• Any recording or publication of a training conducted by Nelkinda, including web-based training, is prohibited.

Disclaimer

• Nelkinda shall not be liable for damages of any kind resulting from errors or omissions in the training materials. Nor shall Nelkinda be liable for any damages resulting from the use of the training materials or other information conveyed at a Nelkinda training.
